| 内容記述 | The main topic of this article is the formation of contract in French law. In French civil code, unlike Japanese and German civil codes and the Uniform Commercial Code in the US, there are no exact provisions regarding how to form a contract or definitions for offer and acceptance. There is, however, the word "consentement" in article 1108 and this is a legal word with close ties to "offer". Therefore, this essay primarily discusses the fundamental principle of article 1108 and the structural relation between "consentement" and an offer to form a contract. | |||||
