However, it is thought that the limitation against them of the minimum requirement degree according to the content of duty and the position on office is not a violation of the constitution of Japan.\nThe purpose of this study is to analyze free speech of public sector employees in the United States of America. The first chapter describes a series of judicial precedents, mainly United States Supreme Court cases. The second chapter describes the content of Garcetti v. Ceballos. The last chapter analyzes the Garcetti decision, especially \"a brightline rule\" that was applied in this decision, and the influence of the Garcetti decision on free speech of public school educators.
