| 内容記述 | Under German law, an heir can disclaim the right of inheritance and legitime (Pflichtteil) in a contract with the decedent before inheritance begins (§2346 German Civil Code (BGB), Erbverzicht). Notarization by a notary public is required for the disclaimer contract (§2348 BGB). This study examines how the notary public is relevant to disclaimer contracts under German law. In a series of proceeding, a notary public can help to ensure that the existence of documents related to inheritance is not overlooked after the decedent’s death, and to avoid the incorrect recognition in inheritance. Additionally, it is understood that §2348 BGB aims to accomplish the “protective,” “warning,” and “proving” functions. Fulfilling these functions plays an important role in the argument over disclaimer contracts and notarization. Under German law, §2348 BGB contributes to the interests of both the decedent and the disclaimer. This is distinctive compared with the purpose of requiring permission from the family court for a prior disclaimer of legitime in Japan. |
